The trust had never been updated and called for the assets to be distributed outright 50/50 to her two adult children. Unfortunately, one of the children, my client’s brother, had predeceased their mother a few years earlier. As a result, his portion of the inheritance was passed outright to his two teenage children.

This likely was not their grandmother’s intention. If she had updated her trust after her son’s death, she could have included provisions to ensure her granddaughters had structured access to the funds, such as setting up continuing trusts.
