Why the Holidays Are the Perfect Time to Talk About Estate Planning with Loved Ones

As we prepare for the holiday season and look forward to spending time with family and loved ones, it’s important to address a crucial but often overlooked topic: the need for open conversations with your family members about planning for the future. Whether you’re speaking with your elderly parents or your adult children—especially those with kids of their own—this is an opportunity to ensure there’s a plan in place for life’s unexpected moments.

The Importance of Starting the Conversation

In our busy lives, it’s easy to postpone these discussions, thinking there will always be time later. However, life is unpredictable, and without a plan, your family could face unnecessary stress, financial burdens, or disputes. The holidays, when families often gather, provide a natural opportunity to have these meaningful conversations in a supportive and familiar environment.

Having a plan isn’t just about protecting assets; it’s about safeguarding your family’s future and honoring your wishes. Open discussions now can prevent difficult situations later.

A Real-Life Example

One case that stands out involved a client who came to me after the death of her mother. Her mother had a trust that was set up over 20 years ago when her estate was modest but had since grown to over $3 million. The trust had never been updated and called for the assets to be distributed outright 50/50 to her two adult children. Unfortunately, one of the children, my client’s brother, had predeceased their mother a few years earlier. As a result, his portion of the inheritance was passed outright to his two teenage children.

This meant that each grandchild inherited over $750,000 at age 18 with no restrictions on how the money was to be spent. One grandchild dropped out of school and spent her inheritance quickly. This likely was not their grandmother’s intention. If she had updated her trust after her son’s death, she could have included provisions to ensure her granddaughters had structured access to the funds, such as setting up continuing trusts.

Comprehensive Planning: A full trust plan includes not only asset distribution but also essential health care documents such as advance health care directives and powers of attorney. These documents ensure your medical wishes are honored and your loved ones aren’t burdened with difficult decisions during emergencies.
