Received a Social Security Overpayment Notice? Take These Steps Before You Pay

Social Security overpayments can happen for several reasons, including changes in earnings, reporting delays, benefit calculation errors, or changes in eligibility. Receiving a notice does not automatically mean you agree with the amount owed or that you must immediately write a check. The Social Security Administration gives beneficiaries specific rights to question the decision, request a waiver in certain circumstances, or arrange a manageable repayment plan.

So, what should you do when you receive one of these notices? Well, let’s first talk about why these overpayments occur in the first place.

Why Social Security Overpayments Occur

Many beneficiaries assume an overpayment means they did something wrong, but that’s not always the case. Overpayments can result from delayed wage reporting, changes in disability or retirement status, adjustments to survivor or spousal benefits, or administrative processing delays. In some cases, beneficiaries report changes promptly, but payments continue until SSA processes the update.

Penalties Can Reach Beyond Your Pockets

These overpayments can not only impact you, but they could impact your family after you’ve died. An Atlanta-area publication, KWQC, reported on a retired MARTA bus driver, David Morgan, who received an overpayment letter. The notice demanded that he pay back $20,000 in Social Security overpayments made to his deceased brother, Dennis. If he didn’t, he could lose his own benefits. As you can imagine, this is incredibly overwhelming.

“Like anybody, if you stopped somebody’s source of income, what can you do? You can’t pay your bills. My wife and I would be devastated because we still got bills,” Morgan told KWQC.

That being said, you aren’t without your options. You need to move forward with a calm approach to the situation and understand your options. Here’s what you need to know…

Read the Entire Notice Before Taking Action

The first step after receiving an overpayment notice is to carefully read every page rather than focusing only on the amount listed. According to the SSA, the notice explains why the agency believes an overpayment occurred, the time period involved, the amount owed, and the options available to you, including repayment, appeal rights, and waiver requests.

In some cases, overpayments result from changes in earnings, marital status, work activity, living arrangements, or other information that affected benefit eligibility or payment calculations. Before writing a check or making an online payment, compare the notice with your own records to determine whether the information appears accurate.

Understand That You Have Options Beyond Immediate Repayment

Many people mistakenly believe an overpayment notice means they have no choice but to repay the entire amount immediately. In reality, the SSA provides several official options depending on your circumstances. The two main being:

If you believe the agency made a mistake about the overpayment or its amount, you can file an appeal requesting reconsideration of the decision.
If you believe the overpayment was not your fault and repaying it would cause financial hardship or would otherwise be unfair, you may request a waiver of recovery using SSA Form SSA-632.

It’s also important to note that beneficiaries who submit an appeal or waiver request within 30 days of receiving the notice generally won’t have collection activity begin while SSA reviews the request. Acting quickly can preserve important rights, even if you’re still gathering documentation.

Be Alert for Scams Related to Overpayment Notices

Unfortunately, scammers frequently take advantage of public concern about Social Security by pretending to represent the SSA. The Consumer Financial Protection Bureau warns that fraudsters often pressure older adults to make immediate payments using gift cards, cryptocurrency, wire transfers, or other unusual payment methods.

Remember that SSA generally mails official overpayment notices. The agency will not demand immediate payment using gift cards, cryptocurrency, prepaid debit cards, or wire transfers. If you receive an unexpected phone call claiming your benefits will be suspended unless you pay immediately, hang up and contact SSA using an official phone number or your My Social Security account.

Work With the SSA to Resolve the Situation

If, after reviewing the notice, you determine that the overpayment is accurate, you still may have repayment options that better fit your financial situation. The SSA allows eligible beneficiaries to request a different recovery rate if the standard repayment would create financial hardship, and people who no longer receive benefits may be able to establish a payment plan.

The agency also offers online repayment in some cases when the notice includes payment instructions and a Remittance ID, but repayment should only occur after you’ve decided not to pursue an appeal or waiver if those options apply. Staying in communication with the SSA and responding within the deadlines listed on your notice is critical because failing to respond can eventually lead to collection actions.

While cost-of-living adjustments may increase monthly benefits over time, they do not eliminate responsibility for resolving legitimate overpayments, making prompt communication especially important.

FAQs About Social Security Overpayment

Here are three of the most frequently asked questions (FAQs) about dealing with Social Security overpayment.

Will Social Security stop my benefits immediately? Not necessarily. SSA provides notice before beginning recovery, and timely appeals or waiver requests generally pause collection while the agency reviews your case.
Can I make smaller monthly payments? Often, yes. If repayment would create financial hardship, SSA allows many beneficiaries to request a lower recovery rate or establish a payment plan.
What if the overpayment wasn’t my fault? You may qualify to request a waiver if you were not at fault and repayment would create financial hardship or otherwise be unfair.

Respond Promptly But Don’t Panic

Receiving a Social Security overpayment notice can feel overwhelming, but it doesn’t mean you have to send money immediately. You have the opportunity to review the decision, appeal if you believe it’s incorrect, request a waiver in qualifying situations, or arrange a repayment plan that better fits your finances. The key is to act before the deadlines in your notice so that you don’t have to deal with more headaches along the way.
